Premarital Agreements and Second Marriages; Avoid a Legacy of Hate by Careful Planning

Second marriages are increasingly the norm in our society. If both spouses have children by prior marriages there is potential for conflict. Avoid a legacy of hate by careful planning. Virginia law provides certain inheritance rights to surviving spouses. These rights may not conform to the expectations of either spouse or their children. Children have no statutory inheritance right but usually expect to share in their deceased parent’s estate. Consider a pre-marital or marital agreement that can address these expectations and prepare wills and trusts that leave no room for misinterpretation.
